Terms of Service
Last Updated: March 18, 2026
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Thrmal Group LLC ("Thrmal," "we," "us," or "our"), governing your access to and use of the Thrmal.ai educational platform, including all courses, content, tools, and related services (collectively, the "Service"). By creating an account or accessing the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent. By accessing the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate accounts of users who do not meet eligibility criteria.
2. Account Creation and Security
To access most features of the Service, you must create an account by providing your name, a valid email address, and a password. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to immediately notify Thrmal at support@thrmal.co of any unauthorized use of your account or any other security breach. Thrmal will not be liable for any loss or damage arising from your failure to comply with this obligation. You may not transfer your account to any other person or entity.
3. License to Use the Service
Subject to your compliance with these Terms, Thrmal grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial educational purposes. You may not sublicense, sell, resell, transfer, assign, or otherwise exploit the Service or any content therein for any commercial purpose without express written consent from Thrmal.
4. Course Access and Content
Thrmal.ai offers tiered access to educational content. Free accounts may access certain modules and course previews. Paid tiers (including Level 3 and Level 4 subscriptions) provide access to additional content as described on the pricing page. Access to paid content requires a valid payment method and subscription in good standing. Thrmal reserves the right to modify, discontinue, or limit access to any course content at any time with reasonable notice where practicable. Course availability dates (including Level 3 — May 1, 2026 and Level 4 — June 1, 2026) are target dates and subject to change.
5. Acceptable Use
You agree that you will not, under any circumstances:
- Copy, reproduce, distribute, republish, download, display, post, transmit, or sell any portion of our course content, curriculum materials, video content, or written materials without express written authorization;
- Use the Service for any unlawful purpose or in any way that violates applicable local, state, national, or international law or regulation;
- Attempt to gain unauthorized access to any part of the Service, its related systems, or networks;
- Use automated tools, bots, scrapers, or similar means to access or index the Service;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein;
- Engage in any conduct that restricts or inhibits any other user from using or enjoying the Service.
6. Intellectual Property
All content on the Thrmal.ai platform — including but not limited to course materials, curriculum text, case studies, module structures, assessments, software, graphics, logos, trademarks, and the "Liftline by Thrmal" brand — is the exclusive intellectual property of Thrmal Group LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Nothing in these Terms grants you any right, title, or interest in any Thrmal intellectual property except as expressly stated herein. You retain ownership of any original work you create during coursework exercises; however, you grant Thrmal a non-exclusive, royalty-free license to use anonymized examples of such work for educational improvement purposes.
7. User-Generated Content
If the Service allows you to submit, post, or share content (including forum posts, questions, or project submissions), you grant Thrmal a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with the operation of the Service. You represent and warrant that you own or have the necessary rights to grant this license. You are solely responsible for any content you submit.
8. Payment and Refunds
Certain features of the Service require payment. All prices are listed in United States Dollars (USD) and are subject to change with notice. Payment is due at the time of purchase or subscription renewal. Refunds may be requested within 7 days of purchase for annual subscriptions if you have not accessed more than 20% of the paid content. Monthly subscriptions are non-refundable once the billing period has begun. To request a refund, contact billing@thrmal.co. Thrmal reserves the right to deny refund requests that appear to be fraudulent or abusive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THRMAL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. EDUCATIONAL CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE IN ANY FIELD.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THRMAL GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THRMAL'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO THRMAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Thrmal Group LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
12. Termination
Thrmal reserves the right to suspend or terminate your account and access to the Service, at its sole discretion, immediately and without prior notice or liability, for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Cook County, Illinois. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Changes to Terms
Thrmal reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, sending an email notification.
